Methodological note

The statistics for bankruptcy proceedings is drawn up by the Public Law Corporation of Land and Mercantile Registrars of Spain. Between 2005 and 2020 it has been carried out by the INEreplacing the suspension of payments and bankruptcy declaration statistics.

The purpose of these statistics is to provide quarterly information about the number of insolvent debtors by legal status and type of bankruptcy (voluntary, necessary or subsequent).

Bankruptcy proceedings admitted/filed: proceedings filed by the debtor or the creditor of this debtor in the event of the insolvency of the company or a financial position in which the debtor's obligations cannot be regularly met.

Voluntary bankruptcy: bankruptcy in which the application is filed by the debtor within the two months following the date on which their state of insolvency became known.

Necessary bankruptcy: bankruptcy in which the application is filed by any of the debtor's creditors and which specifies the origin of the credit, its type, amount, acquisition date and maturity.

Subsequent bankruptcy: bankruptcy in which the application is submitted by a bankruptcy mediator after the previous non-acceptance, or non-compliance, of an Extrajudicial Payment Agreement, thus continuing the pre-bankruptcy procedure. The judge must agree on the immediate declaration of insolvency.
