Methodological note

Definition of concepts

Centre of Worship
Public or privately owned building or establishment that is open to the public and legally recognised, declared or certified by the respective religious church, confession or community in accordance with the Organic law on religious freedom, and mainly and permanently destined for the collective exercise of worship activities.

Methodological aspects

In the field of the fundamental right to religious freedom, and in order to guarantee the real and effective guarantee of churches, confessions and religious communities to establish centres of worship, Decree 94/2010, of July 20, guarantees the exercise of this right and establishes municipal urban planning projects to provide sites qualified as community equipment systems, which include those of a religious nature. The opening of places of worship is a right that administrations must oversee.

Centres of worship that are open to the public must meet the required material and technical conditions to guarantee the safety of their users and the hygiene of their facilities, and to avoid disturbances to third parties. These conditions must be adequate and proportionate, in order not to impede or hinder the activities performed in these centres.

Places of worship located in hospitals, care centres, education centres, cemeteries, mortuaries and penitentiary centres are not considered to be centres of worship, and neither are those located in public or privately owned spaces that are used for other main activities.

Churches, confessions and religious communities conducting their activity in Catalonia and that wish to obtain a municipal license must be registered in the State Register of Religious Entities.
